Terms and conditions

1. DEFINITIONS

Application / Platform – a web application available at: https://connect.amberstone.pl, intended for Users who are interested in cooperating with the Service Provider as interim managers. The Application enables Users to create and manage their professional profile, submit and update Application Documents, indicate availability and cooperation preferences, and receive information about interim assignments offered by the Service Provider.

Interim Manager – a User who, through the Application or the Website, submits their professional profile and expresses interest in cooperating with the Service Provider on interim management assignments.

Business Form – an interactive form available on the Websites at the following addresses: https://amberstone.pl, https://interim.amberstone.pl, https://join.amberstone.pl, https://fteam.pl, https://it-simplicity.pl, https://blueamber.com.pl, and in the “Contact” tab of each of these Websites, which enables the User to contact the Service Provider in order to establish a business relationship.

Recruitment Form – an interactive form available on the Websites at the following addresses: https://amberstone.pl, https://interim.amberstone.pl, https://join.amberstone.pl, https://fteam.pl, https://it-simplicity.pl, https://blueamber.com.pl, that enables the User to apply for specific Job Offers.

Applicant Database Registration Form – an interactive form available on the Websites at the following addresses: https://amberstone.pl, https://interim.amberstone.pl, https://join.amberstone.pl, https://fteam.pl, https://it-simplicity.pl, https://blueamber.com.pl, that enables the User to send Application Documents which will be the basis for the Service Provider to provide the Job Offer Notification Service.

Database of Applicants – a database containing data of Users who agreed to record their personal data in the database maintained by the Service Provider for the purpose of presenting Job Offers or interim assignment opportunities that match their qualifications.

Job Offers – employment offers submitted by the Client (including employment based on civil law contracts) for positions within the Client’s own structure, for which the Service Provider is searching for candidates.

Client – an entity for which the Service Provider provides recruitment services.

General Terms and Conditions, GTC – this document.

Application Documents – CV, cover letter, profile data, or other documents and information submitted to the Service Provider by the User in order to apply for Job Offers or interim assignments.

Privacy Policy – a document specifying the principles and rights of Users related to the processing of their personal data, available on the Website.

Website – websites maintained by the Service Provider at: https://amberstone.pl, https://interim.amberstone.pl, https://join.amberstone.pl, https://fteam.pl, https://it-simplicity.pl, https://blueamber.com.pl.

Job Offer Notification Service – an electronic service provided to Users who declared willingness to receive Job Offers matching their qualifications based on Application Documents.

Interim Assignment Notification Service – an electronic service provided to Users (Interim Managers) who declared willingness to receive interim assignment opportunities that match their qualifications and availability.

Service Provider – Amberstone Associates Sp. z o.o., with its registered seat in Warsaw, pl. Jana Henryka Dąbrowskiego 1, 00-057 Warsaw, entered in the Register of Entrepreneurs, KRS: 0000419720, NIP: 5252530912, REGON: 146116270, share capital paid in full: PLN 120,000.

User – any person who visits the Website or uses services or functionalities offered on the Website or in the Application.

2. INTRODUCTORY PROVISIONS

2.1 These General Terms and Conditions specify the terms and conditions of providing the services by the Service Provider, in particular the terms and conditions of using the Website and the Application by Users.
2.2 Insofar these Terms and Conditions regulate the provision of electronic services, they are the terms and conditions referred to in Art. 8 of the Act of 18 July 2002 on Providing Services by Electronic Means.
2.3 Each User is obliged to read these General Terms and Conditions before using the Website or the Application.

3. TERMS AND CONDITIONS OF USING THE WEBSITE AND APPLICATION

3.1 The aim of the Website is to present Job Offers and search for persons interested in employment or interim assignment cooperation.
3.2 The use of the Website and the Application is free of charge.
3.3 The User shall provide accurate and up-to-date data and may use the Website and Application only for personal purposes.
3.4 The User shall not interfere with the functioning of the Website or the Application, nor submit unlawful content.
3.5 The User is required to update their profile in the Application in the event of any change to their data or availability.

4. SERVICES

4.1 The Service Provider provides electronic services, enabling Users to:

• browse content on the Website,

• use the Business Form,

• use the Recruitment Form,

• use the Applicant Database Registration Form,

• receive the Job Offer Notification Service,

• receive the Interim Assignment Notification Service through the Application.

4.2 The Service Provider does not guarantee the presentation of any Job Offers or interim assignment offers.

5. TERMINATION OF THE AGREEMENT

5.1 The User may terminate services at any time without giving cause.
5.2 Users with an account in the Application may request deletion or anonymization of their profile by contacting dataprotection@amberstone.pl.

6. WITHDRAWAL FROM THE AGREEMENT

6.1 The User may withdraw from the agreement within 14 days from the date of its conclusion, by notifying the Service Provider.
6.2 A withdrawal template form is provided in Appendix 1.

7. COMPLAINTS

7.1 Complaints may be submitted to: dataprotection@amberstone.pl
7.2 Complaints will be handled within 14 days.

8. PERSONAL DATA PROCESSING

8.1 The personal data of Users who use services offered on the Website or in the Application are processed in accordance with the Privacy Policy.

9. CHANGES TO THE TERMS

9.1 The Service Provider may amend these GTC due to justified legal or operational reasons.
9.2 Users will be informed through publication of the updated GTC on the Website.

10. FINAL PROVISIONS

10.1 These GTC shall become effective on the date of publication on the Website.
10.2 Matters not regulated herein shall be governed by Polish law.
10.3 Disputes shall be settled by competent courts in Poland.
